Waiuku Tool Library Member's Agreement and Tool Use Policy
- Members must be 18 years old or have the signed consent of their parent or guardian to join the Waiuku Tool Library.
- Before borrowing tools, every member must:
- create a MyTurn account;
- review and sign this User Agreement;
- have their identity and address verified by a Waiuku Tool Library staff member or volunteer.
- A Waiuku Tool Library staff member may assist in explaining how to operate tools, but a member confirms by taking possession of any tool that they are capable to using the tool safely and properly.
- While Waiuku Tool Library is committed to maintaining all tools, it is not responsible for any defects in any borrowed tools.
- If a member borrows a tool and learns that the tool has become unsafe or is in a state of disrepair, that member must immediately discontinue use of the tool, return the tool to Waiuku Tool Library, and notify the Library of the issue.
- Only Waiuku Tool Library members are authorised to use Waiuku Tool Library tools and equipment.
- Members will not be charged for borrowing tools. A bond may be required for larger items.
- The standard loan period of any tool is 7 Days; however, this may be shorter for rare and/or high demand tools.
- Only Waiuku Tool Library -marked tools are available for loan. Tools belonging to the Community Workshop cannot be taken off-site by either Tool Library or Community Workshop members.
- All tools borrowed are to be returned to the Waiuku Tool Library by close of business on the date that the tool is due to be returned.
- If a tool is returned late, the Member may be required to pay a late fee. MyTurn describes late fees for each tool. Late fees are capped at the full replacement cost of the tool, plus a $5 admin fee in the case of missing or damaged tools.
- Waiuku Tool Library may charge a Member to replace a tool. Charging the Member for the full replacement cost plus an administrative fee of $5, if that Member damages a tool or does not return a tool.
- Fines in excess of $10 must be paid in full before borrowing additional tools.
- Waiuku Tool Library reserves the right to take appropriate steps to retrieve damaged or unreturned tools or unpaid fines and fees. In such situations, the Waiuku Tool Library reserves the right to revoke membership and take legal action. Waiuku Tool Library also reserves the right to forgive fees at its discretion.
- Members may renew a tool if no other member has reserved that tool. Tools may be renewed twice. Waiuku Tool Library reserves the right to refuse or limit renewals and may do so based on demand.
- All tools are to be returned clean and in the same or better condition as they were when issued, excluding normal wear and tear. Members must pay for damage to, or for the loss of, any tool in their possession and accept Waiuku Tool Library assessment of fair restitution for damage, dirtiness, delinquency, or loss of a tool in part or whole. A restitution amount may equal the full replacement cost of the tool plus a $5.00 administrative fee.
- Consumables such as blades, sandpaper and fuel are the responsibility of the member or items can be purchased from the Tool Library at minimal cost.
I have read and fully understand the rules and regulations of the Waiuku Tool Library as set out in this Member’s Agreement and Tool Use Policy and I understand that failure to comply with any of these rules may result in revocation of my borrowing privileges, legal action against me, or both. I have also read and signed a Liability Waiver form relinquishing any and all claims against Waiuku Tool Library and associated bodies.
